Although she previously refused to comment on the purpose of her Malawi trip, Madonna finally confirmed through her rep that she has plans to adopt again while in the African nation. The singer will attempt to formally adopt four year old Chifundo “Mercy” James at hearing on Friday.

“I am also officially confirming that Madonna has indeed filed an application to adopt Mercy James, a girl she met at an orphanage she visited two years ago on a previous trip to Malawi.

“Madonna is following all required procedures and is waiting for a judge to hopefully grant her an adoption by this Friday.”

Madonna’s attorney, Alan Chinula, claimed there are no Malawian laws standing in the way of the adoption.

“I am not sleeping sleepless nights over this,” Chinula tells Us. “I don’t see any law in Malawi that can stop this adoption. She just has to wait to hear from me when I get the result” on Friday, he says. She is not required to attend the hearing, Chinula adds, “although she can attend if she so chooses.”

Mercy’s 18 year old unwed mother passed away soon after giving birth. Fortunately, her uncle, Peter Baneti, “has already signed off the consent forms, and Madonna counter-signed them,” according to Chinula.

    I don’t get the negativity surrounding this story, she wants to take an older child, who may have living relatives, but they have let her live in an orphanage since she was a baby. I think it’s a wonderful thing, and Mercy will have a far better life and Madonna is donating enough money to help support 25,000 other orphans in a country ravaged by AIDS. I see this as a win-win for everyone, and certainly very generous and kind on Madonna’s part. Again I am confused by the bad feelings towards such a kind act.
