Attorneys representing Nicole Richie fought in court today in an effort to get the starlet’s DUI trial delayed. Although her trial was originally scheduled to begin tomorrow in a Los Angeles courtroom, Nicole’s lawyer argued the trial had to be delayed because an expert witness would not be available to testify.
“The trial will not happen (Wednesday)” as scheduled, said Jane Robison, spokeswoman for the Los Angeles County District Attorney’s Office. “Richie’s attorney filed a motion … stating that their key witness, a drug expert, was unavailable for trial.”
Nicole’s lawyer claimed the trial should be delayed until August 5. The County Commissioner Steven Lubell quickly shot down that request, and ordered both sides to court tomorrow to argue why the trial should be postponed again.
Nicole was not in court today, and it’s doubtful she will be there tomorrow; her rep said she traveled to Canada to watch boyfriend (and baby-daddy) perform with Good Charlotte Tuesday evening in Calgary.
If convicted on DUI charges, Nicole will face a minimum of four days behind bars, as this would be her second DUI conviction.

4 days? Really? Just suck it up and go to jail Nicole. The longer you delay it, the more likely you are to have to leave your baby to spend time in jail.
