Kevin Federline’s attorney, Mark Vincent Kaplan, said he’s ready to make the next move in KFed’s custody battle with Britney Spears. Although Britney managed to stall her scheduled deposition on December 12, Kaplan claimed he will have her deposed very soon.

“Britney Spears will have her deposition early this year,” Kaplan said. “We’ve got a lot to talk about.”

Though Spears cited physical illness and anxiety for her absence [from the last deposition], Kaplan said, “She was, in fact, out later that day and night. It’s not fourth grade where you get a doctor’s note and it’s all okay.”

“Kevin isn’t interested, nor am I, in punishing her. We just want to get information necessary to proceed further. I hoping remedies which include continuing hearings are all theoretical.”

Kaplan confirmed Kevin and his sons, Sean Preston and Jayden James, had a lovely holiday together.

“It was a good Christmas for all,” Kaplan confirms. “They were great. Kevin had all of his kids and it was a big, wonderful family setting. He was really happy, and the kids were happy.”

When asked what he hopes in 2008, Kaplan replied, “I hope we will prevail.”

    I hope he prevails too. And how sad is that really? That I’m rooting for Kevin-fucking-Federline? It drives me nuts that she’s so gross now that I have to stick up for him. But, he’s obviously the lesser of two evils in this situation.

    T2M said it all. Take the kids away and leave them with the lesser of the two evils, the poor things. Oh, and leave provisions for the YEARS of therapy they’re no doubt gonna need.
